Recovering the Compensation You Need Following a Car Accident
It is important to understand that regardless of who caused the car accident, medical expenses are covered under your own personal injury protection (PIP) coverage, up to the policy limits.
Medical expenses incurred above and beyond PIP policy limits, as well as lost wages, pain and suffering and other damages are usually covered through a claim against the at-fault driver's bodily injury coverage. However, when the at-fault driver doesn't have insurance or has inadequate bodily injury coverage, you can still be compensated by making a claim under your own uninsured motorist (UM) or underinsured motorist (UIM) policy:
- Uninsured motorist (UM): If you are injured in an accident involving an uninsured motorist, or if you are injured in a hit-and-run accident, your own uninsured motorist policy will provide compensation for your losses up to policy limits.
- Underinsured motorist (UIM): In serious accidents, it is possible that your medical expenses and other damages will exceed the policy limits of your PIP coverage and the at-fault driver's bodily injury coverage. This is especially true if you suffered a catastrophic injury, such as a brain injury or spinal cord injury, where policy limits are exhausted rather quickly. In these situations, your own uninsured motorist policy will provide subsequent compensation for your injuries, up to policy limits.
Our law firm offers more than a decade of experience, including experience as a former insurance defense counsel. We know how to obtain the maximum compensation to which our clients are entitled, whether they have suffered a shoulder injury or bone fracture, or a more catastrophic injury.
